Oracle v Google Copyright Trial in Progress

The battle between Google and Oracle over Android’s use of Java has gone to federal court, and the trial is expected to conclude in June. CBS San Francisco Bay Area reports, “Former Google CEO Testifies in Oracle-Google Copyright Trial.” The brief write-up reveals the very simple defense of Eric Schmidt, who was Google’s CEO while Android was being developed (and is now CEO of Google’s young parent company, Alphabet): “We believed our approach was appropriate and permitted,” he stated.
Java was developed back in the ‘90s by Sun Microsystems, which was bought by Oracle in 2010. Google freely admits using Java in the development of Android, but they assert it counts as fair use—the legal doctrine that allows limited use of copyrighted material if it is sufficiently transformed or repurposed. Oracle disagrees, though Schmidt maintains Sun Microsystems saw it his way back in the day. The article tells us:
“Schmidt told the jury that when Google was developing Android nine years ago, he didn’t believe the company needed a license from Sun for the APIs. “We believed our approach was appropriate and permitted,” he said.
“Under questioning from Google attorney Robert Van Nest, Schmidt said that in 2007, Sun’s chief executive officer Jonathan Schwartz knew Google was building Android with Java, never expressed disapproval and never said Google needed a license from Sun.
“In cross-examination by Oracle attorney Peter Bicks, Schmidt acknowledged that he had said in 2007 that Google was under pressure to compete with the Apple Inc.’s newly released iPhone.”
Yes it was, the kind of pressure that can erode objectivity. Did Google go beyond fair use in this case? The federal court will soon decide.

Score One for Yandex

Russian search powerhouse Yandex has successfully sued Google, we learn from re/code’s article, “Meet the Russian Company that Got Its Antitrust Watchdog to Bite Google.” Reporter Mark Bergen interviewed Yandex’s Roman Krupenin, who has led this legal campaign. In his intro, Bergen relates:
“In October, Russia’s antitrust authority ruled that Google’s practice of bundling its services on Android handsets violated national law. The case’s lead complainant was Yandex, an 18-year old Web search and advertising company. It’s not a global name, but is big in Russia. Last quarter, Yandex raked in $233.1 million in revenue. (For context, Google averaged about $179 million in sales a day over the same period.) Most Russians use Yandex for Internet searches — an estimated 57 percent in the last quarter, though that share has slipped in recent years. The culprit? According to Yandex, it’s the favored position of Google’s apps, including its search one and its browser, on Android smartphones, which outnumber iPhones in Russia considerably. To fight it off, Yandex has pushed to cut handset agreements of its own: It finalized one with Lenovo last year, and paired with Microsoft last month to make Yandex’s homepage and search results the Russian default for Windows 10.”
Furthermore, we’re reminded, Yandex is also taking part in the EU’s latest antitrust investigation. Naturally, Google is appealing the decision. Individualized Facebook Search

Facebook search is a puzzle. If you want to find a specific post that you remember seeing on a person’s profile, you cannot find it unless it is posted to their timeline. It is a consistent headache, especially if you become obsessed with finding that post. Mashable alerts us to a new Facebook pilot program, “Facebook May Soon Let You Search Individual Profile Pages.” Facebook’s new pilot program allows users to search for posts within a profile.
The new search feature is only available to pilot program participants. Based on how the feedback, Facebook will evaluate the search function and announce a potential release date.
“Facebook says it’s a small pilot program going around the U.S. for iPhone and desktop and that users have requested an easier way to search for posts within a person’s profile. The feature is limited in nature and only showing up for a select group of people who are part of the pilot program. The social network will be evaluating feedback based on the pilot. No plans for an official rollout have been announced at this time.?”
The search feature shows up on user profiles as a basic search box with the description “search this profile” with the standard magnifying glass graphic. It is a simple addition to a profile’s dashboard and it does not take up much space, but it does present a powerful tool.
Facebook is a social media platform that has ingrained itself into the function of business intelligence to regular socialization. As we rely more on it for daily functions, information needs to be easy to recall and access. The profile search feature will probably be a standard Facebook dashboard function by 2016.

Microsoft Goes Mobile with Delve

Microsoft has made enhancements to the core functionality of Delve, as well as rolling out native mobile app versions for iOS and Android. ZDNet breaks the news in their article, “Microsoft Delivers iOS, Android Versions of Delve.”
The article begins:
“Microsoft has made native mobile versions of its Delve search and presentation app available for Android phones, Android wear devices and iPhones. Delve presents in card-like form information from Exchange, OneDrive for Business, SharePoint Online and Yammer enterprise-social networking components. Over the coming months Delve will be adding more content sources, including email attachments, OneNote and Skype for Business.”
This seems like a Microsoft component that has great potential for mobile use, since its focus is “at a glance” information retrieval. Keep an eye on ArnoldIT.com to see what Stephen E. Retail Feels Internet Woes

Mobile Web sites, mobile apps, mobile search, mobile content, and the list goes on and on for Web-related material to be mobile-friendly. Online retailers are being pressured to make their digital storefronts applicable to the mobile users, because more people are using their smartphones and tablets over standard desktop and laptop computers. It might seem easy to design an app and then people can download it for all of their shopping needs, but according to Easy Ask things are not that simple: “Internet Retailer Reveals Mobile Commerce Conversion Troubles.”
The article reveals that research conducted by Spreadshirt CTO Guido Laures shows that while there is a high demand for mobile friendly commerce applications and Web sites, very few people are actually purchasing products through these conduits. Why? The problem relates to the lack of spontaneous browsing and one the iPhone 6’s main selling features: a big screen.
“While mobile-friendly responsive designs and easier mobile checkouts are cited as inhibitors to mobile commerce conversion, an overlooked and more dangerous problem is earlier in the shopping process. Before they can buy, customers first need to find the product they want. Small screen sizes, clumsy typing and awkward scrolling gestures render traditional search and navigation useless on a smartphone.”
Easy Ask says that these problems can be resolved by using a natural language search application over the standard keyword search tool. It says that:
“A keyword search engine leaves you prone to misunderstanding different words and returning a wide swath of products that will frustrate your shoppers and continue you down the path of poor mobile customer conversion.”
Usually natural language voice search tools misunderstand words and return funny phrases. The article is a marketing tool to highlight the key features of Easy Ask technology, but they do make some key observations about mobile shopping habits.
