Jurors for Google v. Oracle Case Exposed to Major Privacy Violation Potential

The article titled Judge Doesn’t Want Google to Google the Favorite Books and Songs of Potential Jurors on Billboard provides some context into the difficulties of putting Google on trial. Oracle is currently suing Google for copyright violations involving a Java API code. The federal judge presiding over the case, William Alsup, is trying to figure out how to protect the privacy of the jurors from both parties—but mostly Google. The article quotes from Alsup,
“For example, if a search found that a juror’s favorite book is To Kill A Mockingbird, it wouldn’t be hard for counsel to construct a copyright jury argument (or a line of expert questions) based on an analogy to that work and to play upon the recent death of Harper Lee, all in an effort to ingratiate himself or herself into the heartstrings of that juror,” he writes. ” The same could be done… with any number of other juror attitudes…”
Alsup considered a straightforward ban on researching jurors, but this would put both sides’ attorneys at a disadvantage. Instead, Google and Oracle have until the end of the month to either consent to a voluntary ban, or agree to clearly inform the jurors of their intentions regarding social media research.

OpenText Buys CEM Platform from HP Inc.

When Hewlett Packard split up its business in 2015, consumer-printer firm HP Inc. was created; that entity got custody of HP’s CEM platform. Now we learn, from an article at TechCrunch, that “OpenText Acquires HP Customer Experience Content Management for $170 Million.” OpenText expects the deal to generate between $85 million and $95 million in its first year alone. Writer Ron Miller describes:
“The package of products sold to OpenText today come from the HP Engage line and includes HP TeamSite, a web content management tool left over from the purchase of Interwoven (which was actually bought by Autonomy before Autonomy was sold to HP), HP MediaBin, a digital asset management solution, HP Qfiniti, a workforce optimization solution for enterprise contact center management, as well as HP Explore, HP Aurasma, and HP Optimost.”
Some suspect HP was eager to unload this division from the time of the company’s split. Even if that is true, OpenText seems poised to make a lot from their investment; Miller cites the blog post of content-management consultant Tony Byrne:
“The most important thing to understand, though, is that as a vendor OpenText is a financial construct in search of a technology rationale. The company follows a ‘roll-up’ strategy: purchasing older tools for their maintenance revenue streams, streams which — while not always large — are almost always very profitable.”
It is true. In contrast to, say, Google’s method of trying nearly every idea conceived within their company and seeing what sticks, OpenText tends to be deliberate and calculated in their decisions. We are curious to see where this investment goes.
Based in Waterloo, Ontario, OpenText offers tools for enterprise information management, business process management, and customer experience management. Launched in 1991, the company now serves over 100,000 customers around the world. They are also hiring in several locations as of this writing.

Oracle v Google Copyright Trial in Progress

The battle between Google and Oracle over Android’s use of Java has gone to federal court, and the trial is expected to conclude in June. CBS San Francisco Bay Area reports, “Former Google CEO Testifies in Oracle-Google Copyright Trial.” The brief write-up reveals the very simple defense of Eric Schmidt, who was Google’s CEO while Android was being developed (and is now CEO of Google’s young parent company, Alphabet): “We believed our approach was appropriate and permitted,” he stated.
Java was developed back in the ‘90s by Sun Microsystems, which was bought by Oracle in 2010. Google freely admits using Java in the development of Android, but they assert it counts as fair use—the legal doctrine that allows limited use of copyrighted material if it is sufficiently transformed or repurposed. Oracle disagrees, though Schmidt maintains Sun Microsystems saw it his way back in the day. The article tells us:
“Schmidt told the jury that when Google was developing Android nine years ago, he didn’t believe the company needed a license from Sun for the APIs. “We believed our approach was appropriate and permitted,” he said.
“Under questioning from Google attorney Robert Van Nest, Schmidt said that in 2007, Sun’s chief executive officer Jonathan Schwartz knew Google was building Android with Java, never expressed disapproval and never said Google needed a license from Sun.
“In cross-examination by Oracle attorney Peter Bicks, Schmidt acknowledged that he had said in 2007 that Google was under pressure to compete with the Apple Inc.’s newly released iPhone.”
Yes it was, the kind of pressure that can erode objectivity. Did Google go beyond fair use in this case? The federal court will soon decide.

Google Throws Hat in Ring as Polling Service for Political Campaigns

The article on Silicon Angle titled Google is Pitching Its Polling Service at Journos, Politicians…Also, Google Has a Polling Division explores the recent discovery of Google’s pollster ambitions. Compared to other projects Google has undertaken, this desire to join Gallup and Nielsen as a premier polling service seems downright logical. Google is simply taking advantage of its data reach to create Google Consumer Surveys. The article explains,
“Google collects the polling data for the service through pop-up survey boxes before a news article is read, and through a polling application…The data itself, while only representative of people on the internet, is said to be a fair sample nonetheless, as Google selects its sample by calculating the age, location, and demographics of those participating in each poll by using their browsing and search history…the same technology used by Google’s ad services including DoubleClick and AdWords.”
Apparently Google employees have been pitching their services to presidential and congressional campaign staffers, and at least one presidential candidate ran with them. As the article states, the entire project is a “no-brainer,” even with the somewhat uncomfortable idea of politicians gaining access to Google’s massive data trove. Let’s limit this to polling before Google gets any ideas about the census and call it a day.

CloudFlare Claims Most Activity from Tor Is Malicious

Different sources suggest varying levels of malicious activity on Tor. Tech Insider shared an article responding to recent claims about Tor made by CloudFlare. The article, entitled, Google Search has a secret feature that shouts animal noises at you, offers information about CloudFlare’s perspective and that of the Tor Project. CloudFlare reports most requests from Tor, 94 percent, are “malicious” and the Tor Project has responded by requesting evidence to justify the claim. Those involved in the Tor Project have a hunch the 94 percent figure stems from CloudFlare attributing the label of “malicious” to any IP address that has ever sent spam. The article continues,
“We’re interested in hearing CloudFlare’s explanation of how they arrived at the 94% figure and why they choose to block so much legitimate Tor traffic. While we wait to hear from CloudFlare, here’s what we know: 1) CloudFlare uses an IP reputation system to assign scores to IP addresses that generate malicious traffic. In their blog post, they mentioned obtaining data from Project Honey Pot, in addition to their own systems. Project Honey Pot has an IP reputation system that causes IP addresses to be labeled as “malicious” if they ever send spam to a select set of diagnostic machines that are not normally in use. CloudFlare has not described the nature of the IP reputation systems they use in any detail.”
This article raises some interesting points, but also alludes to more universal problems with making sense of any information published online. An epistemology about technology, and many areas of study, is like chasing a moving target. Knowledge about technology is complicated by the relationship between technology and information dissemination. The important questions are what does one know about Tor and how does one know about it?

Google Results Now Include Animal Noise Audio

Ever wonder about the difference in the noise a bowhead whale makes versus a humpback whale? This is yet another query Google can answer. Tech Insider informed us that Google Search has a secret feature that shouts animal noises at you. This feature allows users to listen to 20 different animal sounds, but according to the article, it is not a well-known service yet. Available on mobile devices as well, this feature appears with a simply query of “what noise does an elephant make?” The post tells us,
“Ever wondered what noise a cow makes? Or a sheep? Or an elephant? No, of course you haven’t because you’re a normal adult with some grasp of reality. You know what noise a sheep makes. But let’s assume for a minute that you don’t. Well, not to worry: Google has got your back. That’s because as well as being a calculator, a tool for researching coworkers, and a portal for all the world’s information, Google has another, little-known feature … It’s capable of making animal noises. Lots of them.”
I don’t know if we would call 20 animal noises “a lot” considering the entirety of the animal kingdom, but it’s definitely a good start. As the article alludes to, the usefulness of this feature is questionable for adults, but perhaps it could be educational for kids or of some novelty interest to animal lovers of all ages. Search is always searching to deliver more.

Self Driving Bicycle Prank Points to Wider Arena

Technology companies are no stranger to making April Fools’ pranks in the form of media releases. This year, The Inspiration Room shared an article highlighting the Google Self Driving Bicycle, which was of course developed by the Dutch and launched in the Netherlands. The aspect of this story that is not fiction is how often the Dutch cycle. This short post briefs us on the media release,
“Google is introducing the Google Self Driving Bicycle in Amsterdam, the world’s premier cycling city. The Dutch cycle more than any other nation in the world, almost 900 kilometres per year per person, amounting to over 15 billion kilometres annually. The self-driving bicycle enables safe navigation through the city for Amsterdam residents, and furthers Google’s ambition to improve urban mobility with technology. Google Netherlands takes enormous pride in the fact that a Dutch team worked on this innovation that will have great impact in their home country.”
If there’s one truth this article points to, it’s that the field of search seems to be encompassing nearly everything. It is humorous how Google continues to grow new tentacles tackling more and more arenas that have seemingly little to do with search. Despite the fact this self-driving bicycle does not exist yet, it’s clearly no stretch of the imagination — if a company were to make such a product, would there be any other contenders for who would make it?

Who Will Connect the Internet of Things to Business

Remember when Nest Labs had all the hype a few years ago? An article from BGR reminds us how the tides have turned: Even Google views its Nest acquisition as a disappointment. It was in 2014 that Google purchased Nest Labs for $3.2 billion. Their newly launched products, a wifi smoke alarm and thermostat, at the time seemed to the position the company for greater and greater success. This article offers a look at the current state:
“Two and a half years later and Nest is reportedly in shambles. Recently, there have been no shortage of reports suggesting that Nest CEO Tony Fadell is something of a tyrannical boss cut from the same cloth as Steve Jobs (at his worst). Additionally, the higher-ups at Google are reportedly disappointed that Nest hasn’t been able to churn out more hardware. Piling it on, Re/Code recently published a report indicating that Nest generated $340 million in revenue last year, a figure that Google found disappointing given how much it spent to acquire the company. And looking ahead, particulars from Google’s initial buyout deal with Nest suggest that the pressure for Nest to ramp up sales will only increase.”
Undoubtedly there are challenges when it comes to expectations about acquired companies’ performance. But when it comes to the nitty gritty details of the work happening in those acquisitions, aren’t managers supposed to solve problems, not simply agree the problem exists? How the success of “internet of things” companies will pan out seems to be predicated on their inherent interconnectedness — that seems to apply at both the levels of product and business.

Microsoft Makes Fresh Effort to Position Bing

Microsoft is gearing up for a fresh challenge to Google, with a Bing rebranding effort centered on the new “Bing Network.” This marks a different approach to leveraging the MS search platform, we learn from the piece, “Microsoft Rebrands Bing, Challenges Google” at SearchMarketingDaily. The incorporation of Yahoo has a lot to do with it. Reporter Laurie Sullivan writes:
“Microsoft’s message says the network pulls together in-the-moment data from across its mobile, global and local partners to support products that people use daily. And that network continues to grow. With the transition of all U.S. accounts, people and account management from Yahoo to Bing, the network represents an expanding set of partnerships such as AOL, and The Wall Street Journal, which adds more searches and clicks to the network daily, wrote Stephen Sirich, GM of advertising and consumer monetization group at Microsoft, in a post.”
Sullivan later reminds us:
“The shift in brand strategy also marks an end to the Yahoo-Bing Network. The renegotiated search deal between Microsoft and Yahoo in April 2015, five years into the 10-year deal, has ad sales and account management returning to their respective companies.”
The article discusses reasons Microsoft has struggled so to position Bing as an alternative to Google. For example, says one professional, Bing should not have tried to change the model Google had set up, and users had grown accustomed to, for Internet search. Also, Bing’s brand recognition has always lagged behind that of Google. Perhaps that is about to change with this renewed effort. The article states,
